supposed to be open until 10 at night but is actually only open until 8. this is no good for us as we cannot get to a gym until after 8.we are locked in to a 2 year contract can we get out of this? i dont mind paying for a gym as long as i can use it! i dont think it is the gym owners fault as he had a company come in to discounted memberships helpBoth my wife and i are disabled,we joined a gym on the advice of our doctor before christmas. the gym was?
You are covered by the Sale of Goods Act. The services offered are not as described and you are entitled to a full refund. Write to the address where you first paid pointing this out and politely asking for your money back. If this doesn't work, write to their Head Office saying if you don't get a full refund within 14 days you'll start County Court proceedings. If that doesn't work, go to https://www.moneyclaim.gov.uk/csmco2/ind鈥?/a> and issue a summons. You'll get your money back - it would cost them more to defend the summons. Both my wife and i are disabled,we joined a gym on the advice of our doctor before christmas. the gym was?
Get your money back and join somewhere else with disabled facilities.
You should be able to get out of it as they clearly misled you when you signed up for it
You should write a email to Watchdog bbc 1 I think they will help you.
did you have a grace period when you can cancel the contract,if t says 10pm and isn't open they are breaking there contract, speak to them and say it's the only reason you joined if they can't fulfill there side of it you can opt out
you can stop paying it (if you are paying monthly) under the reason you were miss sold it or ask for your money back for the same reason
it may take some time thou and a few snotty letters to get it sorted it took me 6months to get my money back as the gym opened at 8 not at 6am like i was told
If you live in the UK trading standard laws will allow you to exit your contract as you have been miss-sold and as a result the product you purchased is not fit for purpose.
Explain this to the manager and see what his response is.
If he does not allow you exit the contract and refund all money paid to date then contact your citizens advice Bureau. They will usually suggest you put your case in writing to the gym. If this fails you can take the gym to the small claims court (this only costs 拢10).
I find it difficult to believe that the gym would let it get this far as the potential adverse publicity could be very damaging for them indeed.
Good luck!
